A Federal High Court in Lagos on Monday fixed September 29 for continuation of hearing in a suit filed against the Cherubim and Seraphim (C&S) Church over leadership tussle.
The plaintiff, Adepoju Arogundade, filed the suit in February, 2009, seeking an order reinstating him as the rightful leader of the C & S Church in Nigeria.
Joined as first and second defendants are the Registered Trustees of the Church and a member of the church, Adebola Adewuja.
The other three defendants are: Remi Beckley, Mary Oshode and the Corporate Affairs Commission (CAC).
When the case was called on Monday, Justice Ibrahim Buba asked the parties to return on September 29 for continuation of hearing.
The judge said that the court would hear all pending applications on the date.
In his statement of claim, the plaintiff averred that the C & S Church was founded in 1925 by Emmanuel Abiodun, and registered in 1930.
He averred that the church had a constitution which stipulated the mode of leadership succession.
“The constitution provides that after the death of a leader, the oldest in the church is to assume position as the next leader,” he stated.
According to the plaintiff, after the death of his father, he became the oldest member of the church who should be the leader.
Mr. Arogundade stated that instead of appointing him as his father’s successor, Adebola Adewuja was made the leader.
He, therefore, wants the court to declare the appointment a nullity, saying that it contravened the provisions of the church’s constitution.
He also wants the court to restrain the defendants from further appointing a leader of the church, adding that the tenure of Adewuja had expired.
The plaintiff wants further appointment of the church leader suspended until the case is decided by the court.
